The General Terms and Conditions of the GUDshop Online Store are in accordance with Consumer Protection Act (ZVPot-UPB2), based on recommendations GZS in mednarodnih kodeksov za e-poslovanje. S spletno trgovino GUDshop (v nadaljevanju »trgovina« ali »GUDshop«) upravlja podjetje GUD Design d.o.o., ponudnik storitev e-poslovanja (v nadaljevanju »ponudnik«). Ob registraciji v sistem GUDshop, obiskovalec pridobi uporabniško ime, ki je enako naslovu njegove elektronske pošte ter geslo. Z registracijo, prijavo na e-novice ali izvedenim naročilom obiskovalec postane uporabnik. Pogoji poslovanja obravnavajo delovanje GUDshop-a, pravice uporabnika ter poslovni odnos med ponudnikom in kupcem.

 

Access to information

The Bidder undertakes to always provide the Buyer with the following information:

  • company identity (company name and registered office, registry number),

  • contact information that enables the user to communicate quickly and effectively (email, telephone),

  • the essential characteristics of the goods or services (including after-sales services and guarantees),

  • availability of articles (any item or service offered on the site should be accessible within a reasonable time),

  • the conditions of delivery of the goods or the execution of the service (manner, place and time of delivery),

  • all prices must be clearly and unambiguously specified and must show whether they already include taxes and transport costs,

  • payment and delivery method,

  • the validity of the offer,

  • the period within which it is still possible to withdraw from the contract and the conditions for withdrawal; in addition, if and how much it costs the buyer to return the item,

  • an explanation of the complaint process, including any contact information or customer contact information.

Offer items

Due to the nature of online business, GUDshop's offerings are changing frequently and quickly. Prices are presented as Regular Prices and Your Prices. Regular prices are the selling prices of the manufacturer or importer or the prices formulated by the provider. Your price is the price applicable to purchase online in the case of 100 % cash or prepayment payments by TRR transfer. We allow the possibility of error when entering the technical specifications of the articles, the pictures may be symbolic and do not reflect the actual status of the item. Payment methods

The provider offers the following payment methods:

The Bidder issues the invoice to the buyer in a durable medium, with itemized costs and instructions on how to withdraw from the purchase and return the items if necessary and possible. The order is stored electronically on the provider's server and accessible to the customer at any time in his user profile.

 

Prices

Your price applies to all users of the GUDshop Online Store. All prices include VAT unless explicitly stated otherwise. Prices are valid at the time of placing the order and have no predefined validity. Despite the tremendous efforts to provide the most up-to-date and accurate information, the pricing information may be incorrect. In this case, or if the price of the item changes during the processing of the order, the bidder will allow the buyer to withdraw from the purchase, while at the same time the bidder will offer the buyer a solution that will go to mutual satisfaction. The purchase contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order (the buyer receives an email with the status Order confirmed). From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

 

Out of stock items

Most of the products on the website are in stock or in stock. from the supplier of the product and they are delivered on the day of the order, if the order is placed on a working day by 12 noon. In the event that, despite careful stock updating, it happens that the product cannot be delivered within a maximum of three (3) business days, we will notify you in writing or. on the phone. In this case, you can cancel the order completely, confirm the partial order or confirm that you will wait for the product to be back in stock. We will keep you up to date via email whenever possible delivery times. In the event that the longer delivery time does not suit you, you can notify us by email or telephone at any time and we will remove the item from the order or replace it with another one. We apologize for the inconvenience this situation may cause you.

Data security

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments. Secure credit card transactions are managed by the business Braintree (a Paypal company), with a variety of security certifications, and prevention features that protect both buyer and seller . Card information is not stored on the provider's server.  

 

Protection of personal data

The provider undertakes to permanently protect all personal data of the user. For an indefinite period, the provider keeps the IP addresses of all visitors to the GUDshop online store, with registered members also: first and last name, e-mail address, contact telephone number, delivery address and country of residence. The Bidder will use personal information exclusively for the purpose of fulfilling the order (sending information materials, offers, invoices) and other necessary communication. In no case will the user's data be handed over to unauthorized persons. The user is also responsible for the protection of personal data by ensuring the security of his / her username and password and adequate software (antivirus) protection of his / her computer.  

 

Communication

The provider will contact the user through the means of distance communication only if the user does not explicitly object to it. Advertising emails will contain the following components:

  • the sender will be clearly visible,

  • various campaigns, promotions and other marketing techniques will be labeled as such. The terms of participation will also be clearly defined,

  • a clear way to unsubscribe from receiving promotional messages,

  • the desire of the user not to receive advertising messages will be explicitly respected by the provider.

Right of withdrawal and return of goods

The consumer has the right to inform the company within 14 days of receipt of the goods (to the contact email address hello@gud-shop.com) to withdraw from the contract without having to give a reason for his decision. The only cost to the consumer in connection with the cancellation of the contract is the cost of returning the goods. The goods must be returned to the seller within 14 days of the notice of cancellation (purchase). The returned goods must be returned undamaged, in the same quantity and in the original packaging. Goods already used or mounted cannot be returned. When returning items where a promotional code was used, these funds are considered as a discount and will not be refunded (the amount paid back). Payments will be refunded as soon as possible and no later than 14 days after receiving the notice of withdrawal. Returns are refunded to the buyer's TRR. The return of the goods received to the company within the term of cancellation of the contract shall be considered as a notice of withdrawal. The refund option does not apply if the consumer has opened the security seal. For goods which have been manufactured or ordered according to the exact instructions of the consumer, adapted to his particular needs or because of their nature are not suitable for return, there is no possibility of withdrawing from the purchase or return of goods and the refund.

 

Return of Products

Important instructions for returning items:

  • Shipping costs are always borne by the sender unless otherwise agreed in advance. Shipment with ransom is not accepted.

  • If you claim a warranty, you will receive the repaired item as soon as possible if you claim the warranty directly from the manufacturer or his authorized service facility. Authorized service is indicated on the item, on the accompanying warranty card.

Warranty

Items are warranted if stated on the warranty card or invoice. The warranty is valid according to the instructions on the warranty card and when submitting the invoice. Warranty periods are indicated on the warranty card or invoice. Warranty information is also provided on the product introduction page. if there is no warranty information, the item is not warranted or the information is unknown at this time. In the latter case, the buyer may contact the provider who will provide up-to-date information.  

 

A real mistake

When is a mistake real? When:

  • the item does not have the features necessary for its normal use or for the sale of the item does not have the features necessary for the specific use for which the buyer is buying it, which was known or should be known to the seller

  • the item does not have the characteristics and attributes that were explicitly or tacitly agreed upon or prescribed

  • the seller has delivered an item that does not match the pattern or model unless the pattern or model was shown for notice only.

How to check the suitability of an item? It shall be checked with another, flawless article of the same type, at the same time as the manufacturer's statements or indications on the article itself. How is a real mistake enforced? The buyer must notify us of any material defect, together with a detailed description of the defect and at his own expense within the statutory time limit. The buyer also allows us to inspect the item. The right to make material errors is more closely governed by the provisions of the Consumer Protection Act. The consumer may exercise his rights as a result of a material defect by notifying the seller within two months of the date when the defect was discovered. The consumer must give a more detailed description of the error in the error message and allow the seller to inspect the matter. The consumer may notify the seller personally of the error, which must be certified by the seller, sent to the store where the item was purchased, or to the seller's agent with whom it has contracted. The Seller is not responsible for any material defects in the goods which appear after two years have elapsed since the item was delivered. If the subject of the contract between the seller and the consumer is a second-hand thing, the seller is not responsible for the material defects on the goods, which appear after one year has passed since the thing was delivered. A mistake on things is considered to have existed at the time of delivery if it occurs within six months of delivery. The consumer who has duly informed the seller of the defect has the right to require the seller to:

  • debug the goods or

  • returns a portion of the amount paid in proportion to the error or

  • replace the defective goods with new flawless goods or

  • returns the amount paid.

In any case, the consumer shall also have the right to demand from the seller damages, in particular the reimbursement of the costs of materials, spare parts, labor, transfer and transport of products resulting from the fulfillment of the obligations referred to in the previous paragraph of this Article. Complaints and disputes

GUD Design d.o.o. spoštuje veljavno zakonodajo o varstvu potrošnikov in se po vseh močeh trudi izpolnjevati svojo dolžnost zagotavljanja učinkovitega sistema obravnavanja pritožb. The complaint is submitted via email hello@gud-shop.com. The procedure for handling a complaint is confidential. Gud-shop.com is aware that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time required and the costs involved in resolving the dispute, which is also a major obstacle to the consumer from bringing a dispute to court. Therefore, GUDshop is doing its best to resolve any disputes by mutual agreement. Any disputes that are not settled amicably are the responsibility of the Ljubljana court.
